The owner warrants that they are authorised to enter into this management agreement and has the authority of the other owners, if any to make this agreement. The owner and HJPM agree that: HJPM are the exclusive agent in respect of the premises referred to in Listing Form, from the date this form is submitted. 1. By appointing HJPM as the exclusive agent, HJPM may act as if they are the owner and do all things on the owners behalf as necessary to manage the property effectively. 2. The owner warrants that the property referred to in Listing Form is not on the market for sale and will not be on the market for sale for a minimum of 12 months from the date below. The owner undertakes whilst this agreement is in force, they will notify HJPM in writing of any intention to sell the property before any listing agreement is signed. This is so notice under Section 47 of the Residential Tenancies Act 1986 and its amendments may be given to the tenants. 3. Any tenancy arranged in respect of the above property is subject to the Residential Tenancies Act 1986 and its amendments and HJPM will ensure compliance with the terms of the tenancy agreement and any provisions of the Act. 4. The owners name will appear on any tenancy agreement arranged by HJPM. 5. The owner will be bound by any order made in accordance with the Residential Tenancies Act 1986 and its amendments. 6. Water rates and charges are deemed to be a rate and constitute a charge on the land under Section 136 of the Rating Powers Act 1988. If the tenant/occupier makes default in payment of any rates, water rates or charges the owner will be responsible for any unpaid rates, water rates and charges or part thereof in accordance with Section 139 of the Rating Power Act. All fixed water charges are payable by the owner. All metered volumetric and wastewater volumetric are payable by the tenant 7. It is the owner’s responsibility of providing proper buildings insurance, contents insurance, legal liability insurance and landlord protection insurance for the property during the term of all tenancies under this management authority. 8. The owner warrants that the property has all relevant building and resource consents and complies with all council requirements as to building, including town planning requirements, health and safety requirements and fencing of swimming pool requirements. 9. Any repairs, maintenance or works to the property that HJPM carry out will not exceed $300 without first obtaining the prior consent of the owner. However HJPM are not required to obtain the owners consent where the repairs are urgent and necessary or failure to carry out any repairs or works might otherwise affect the well-being, rent ability or health and safety issues of the property or for any repairs/works ordered by the Tenancy Tribunal by a works order. 10. If there is a Body Corporate Administrator for the property the owner must provide HJPM with a copy of the body corporate rules so that we may provide them to the tenant. This is now law under the Unit Titles Act 2010. 11. If the property is to be let furnished the owner must provide a list of chattels which are to be left in property to HJPM or pay the cost as per our hourly rate for HJPM to list all chattels. 12. HJPM will advertise the property for rent in accordance with Listing Form. All costs relating to advertising and letting the property are to be paid by the Owner. Our standard letting fee charge is one week’s rent plus GST or $650 plus GST whichever is the greater and becomes due the day the property is advertised or promoted for rent. 13. HJPM will re-tenant the property each time the property becomes available for rent unless notice is received in writing from the owner that the property is not to be re-tenanted. 14. HJPM will collect a bond equivalent to four weeks rent which will be lodged with tenancy services. At the end of the tenancy the bond will be refunded to the tenants less any deductions HJPM consider to be fair and reasonable. 15. The owner is required to complete a Healthy Homes Compliance Statement for each property. This statement must be attached to every new Tenancy Agreement. Failure to do so carries a $500 fine. We can arrange for a compliance company to complete this on your behalf or you can complete the statement yourself. If the owner has requested to complete the statement themselves and has failed to complete it before the tenancy agreement is ready to be prepared HJPM will attach a Healthy Homes Statement with the information HJPM has on file and organize a compliance company to verify the information. 16. HJPM shall use its best endeavors to ensure continuity of rental and maintenance of the property, but cannot be held liable to the owner for any default in the payment of rent or any damage caused to the property by the tenant or invitees, whether or not the tenancy has been arranged by HJPM. 17. Although HJPM will investigate any defect observed or brought to their attention by the tenant or discovered on an inspection of the property they cannot be held responsible for latent, hidden or structural defects. 18. The owner indemnifies and keeps HJPM and any contractors employed by HJPM protected from all costs, claims, demands, suits, legal proceedings, or loss howsoever arising in the proper management of the property referred to in Listing Form and to reimburse HJPM upon demand for any expenses incurred in the management of the property. 19. HJPM shall be entitled to deduct its proper charges as set out in this listing form and reimbursements for monies expended on the owners account, from rents and any monies collected by it. Where no monies are held the owner agrees to reimburse HJPM within seven days upon written request. 20. HJPM may if necessary withhold owner’s funds to meet payments which are or may become due including HJPM's fees, if insufficient funds are held and payment is not received within 7 days of request HJPM reserves the right to appoint a debt collection agency. All collection costs charged by a debt collection agency instructed by HJPM to collect outstanding monies pursuant to the District Courts Act 1947 and any other costs incurred by HJPM in pursuing monies outstanding is payable by the owner. 21. The Owner agrees that the HJPM has the right to assign this Agreement to a third party without limiting the owners rights to terminate this Agreement as set out in this Agreement. 22. HJPM will endeavour to carry out inspections in the calendar month due, however we cannot be held responsible for late inspections due to delays caused by the tenant or circumstance beyond our control. 23. HJPM shall be entitled to review its charges, management services and terms and conditions of agency from time to time by giving the owner Four weeks’ notice in writing unless new legislation has been passed in which case immediate notice in writing will be given. 24. This Agreement runs from todays date and is for a minimum period of fifty two weeks from the date the first tenancy commences and continues thereafter until cancelled by either party in writing to the other by the giving of four weeks’ notice. The first rent payment collected will be paid direct into the Owner's nominated bank account as detailed in the Schedule by the 2nd business day of the month following, less the letting fee, advertising fee, credit check fee and any other agreed deductions. A statement of account will be emailed to the Owner. 11. It is the Owner’s responsibility to provide proper building insurance, contents insurance, legal liability insurance and landlord protection insurance for the property during the term of all tenancies. 12. The Owner warrants that the property has all relevant building and resource consents and complies with all council requirements as to building, including town planning requirements, health and safety requirements, fencing of swimming pool requirements and the property is drug fee. The owner indemnifies HJPM against any claims, demands, suits, legal proceedings or loss howsoever arising. 13. HJPM will not at any time without the prior consent of the owner give keys to prospective tenants to view a property or release keys to in-going tenants without a signed tenancy agreement. 14. If the property is to be let furnished the Owner must provide a list of chattels to be left in the property. 15. HJPM’s standard letting fee charge for this service is one week’s rent plus GST (minimum charge of $650 plus GST) and becomes due upon the acceptance of the suitable tenant. 16. HJPM may if necessary withhold owner’s funds to meet payments which are or may become due including disbursements and HJPM’s fees. If insufficient funds are held and payment is not received within 7 days of HJPM invoicing the owner, HJPM reserves the right to appoint a debt collection agency. All collection costs charged by a debt collection agency instructed by HJPM to collect outstanding monies pursuant to the District Courts Act 1947 and any other costs incurred by HJPM in pursuing monies outstanding is payable by the owner. 17. It is the owner’s responsibility during the term of the tenancy to regularly check rent payments are being received from the tenants, maintain the property and carry out regular inspections of the property. HJPM cannot be held liable for any non-payment of rent by the tenants or non-performance of the tenancy agreement by the tenants. 18. This Agreement runs for a minimum period of six weeks from the date below and continues thereafter until cancelled by either party in writing to the other by the giving of one weeks’ notice. Cancellation of this agreement by the owner at any time will incur charges to the owner of HJPM’s professional services which are charged at $120 Plus GST per viewing plus $30 plus GST per 15 minutes of time spent carrying out services such as but not limited to: appraisal, advertising and promoting the property. Arranging viewings and meeting tenants at the property, receiving applications, carrying out references, preparing the tenancy agreement and bond form. If the property has not been let to suitable tenants during the initial 6 week period additional charges may apply 19.
